Kroger To Hand $17,000,000 To Customers, Attorneys and Court After Allegedly Overcharging On Prescription Drugs

Kroger is agreeing to a proposed $17 million class-action settlement resolving claims it overcharged insured customers on prescription copays by not reporting lower Rx Savings Club prices as usual and customary rates.

The settlement resolves claims in Kirkbride et al. v. The Kroger Co. that the company failed to report lower discount club prices as its usual and customary rates when billing insurers, which inflated out-of-pocket costs.

Kroger denies any wrongdoing and maintains it correctly reported retail prices.

The class covers individuals in the U.S. and territories who paid for one or more prescriptions at Kroger using insurance from December 9, 2018, through August 23, 2026.

Eligible people can file claims at KrogerSavingsClubSettlement.com by December 21, 2026, with payouts distributed pro rata from the net fund after fees and expenses.

A fairness hearing is set for January 11, 2027.
