Walmart has agreed to pay millions to resolve allegations that it sold expired infant formula and over-the-counter drugs in California stores.
The settlement with district attorneys from Solano, Alameda, Sacramento, San Bernardino, San Joaquin, Sonoma and Yolo counties totals $16 million and was filed in Alameda County Superior Court.
Under the judgment, Walmart is barred from selling infant formula past its “use by” date or expired OTC drugs at any California location.
The retailer must also launch an Enhanced Expired Product & Inventory Compliance Program with employee training and dedicated staff hours to pull expired items.
Sonoma County will receive $2.2 million in civil penalties and $60,000 in cost recovery.
Sonoma County District Attorney Carla Rodriguez said the judgment locks in those sale bans under California law.
“Under California law and the terms of the judgment, Walmart is prohibited from selling infant formula after the ‘use by’ date and expired OTC drugs in California.”
Investigators found no evidence that outdated products caused physical harm, and prosecutors say Walmart cooperated with early compliance steps before the deal was finalized.
