Costco has agreed to a $14 million class action settlement to resolve allegations that it sent Washington consumers promotional emails with false or misleading subject lines.
The settlement received preliminary approval on June 23rd, 2026.
The case covers Washington residents who received a commercial email from Costco, or someone acting on the retailer’s behalf, between June 2nd, 2021, and July 7th, 2026.
The lawsuit alleged Costco violated Washington’s Commercial Electronic Mail Act (CEMA) and Consumer Protection Act (CPA) by using deceptive subject lines to advertise limited-time promotions when the firm knew it was going to extend those promotions past the stated time frame.
According to court documents, examples of the emails included subject lines such as “Today is the last day to access Member-Only Saving” and “Hot Buys available for 5 Days Only.”
Eligible class members who submit a valid claim can receive a cash payment from the settlement fund. The amount each person receives will depend on the total number of approved claims and other factors. No proof is required to file a claim.
Claims may be submitted online or by mailing a completed claim form to the settlement administrator.
The deadline to submit a claim is August 24th, 2026. Those who want to opt out or object to the settlement can do so by August 24th.
A final approval hearing is scheduled for October 2nd, 2026.
Costco maintains that it complied with the law and does not admit any wrongdoing.
