Up To $5,000 Per Person Incoming After Healthcare Firm Settles Data Breach Lawsuit Affecting 904,672 Patients

A healthcare firm has agreed to shell out millions of dollars to settle a class action lawsuit over a data breach that exposed patients’ sensitive information.

According to the settlement administrator’s portal, Essen Medical Associates has agreed to pay $4 million to settle the lawsuit that was filed after hackers gained access to the New York-based healthcare provider’s network.

The data breach impacted 907,782 current or former patients.

“[Essen’s] investigation found that an unauthorized actor accessed certain Essen systems between March 14th, 2023, and March 22nd, 2023, and may have accessed or copied certain information maintained within the Essen environment…

The information included in the affected files varied by individual, and contained, as applicable, individuals’ names, Social Security number, driver’s license or state identification number, US Alien Registration number, non-US identification number, passport number, date of birth, diagnosis, financial account information, health insurance information, lab results, medical history, medical record number, medical treatment, patient account number, patient identification number, physician, and/or prescription information.”

Settlement class members are eligible to receive up to $5,000 for documented losses that arose as a result of the data breach.

An alternative cash payment of $100 will also be provided, where settlement class members will not be required to provide proof of losses.

The deadline to object to the settlement is May 4th. Claims must be submitted by June 1st. A final court hearing on the matter is set for July 7th.
